The 2020 NDAA seeks to improve the efficiency, agility and accountability of the Pentagon, directing DOD to Strengthen the Acquisition System and reform its business. Section 823 of the NDAA provides practical guidance to reducing the burden of competitive procurements, through the use of increased ceilings under 8(a) sole-source. In a memorandum (DARS Tracking Number 2020-O0009) to acquisition and procurement officials, the Acting Principal Director, Defense Pricing and Contracting (DPC), in the Office of the Secretary of Defense (OSD), U.S. Department of Defense (DoD), issued a class deviation for the Defense Federal Acquisition Regulation Supplement supporting sole-source 8(a) procurements already provided for under FAR 6.302-5(b)(4). (*The 2020 NDAA authorized deviation of the approval certification levels required under FAR 6.304).
